This Privacy Policy describes how BA visuals LLC (“we”, “us”, or “our”) collects, uses, and protects personal data when you visit or use the websites https://ba-visuals.com and https://shop.ba-visuals.com (together the “Website”).

Orders, e-mails and the affiliate program. If you order in our shop, subscribe to our e-mails or join our affiliate program, we also process your name or DJ name, your e-mail address, the logo you send us, your order details and, for affiliates, payout details. 3. Comments

When visitors leave comments on the Website, we collect the data shown in the comments form, as well as the visitor’s IP address and browser user agent string to help with spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to determine whether you are using it. Gravatar’s privacy policy is available at: https://automattic.com/privacy/

After approval of your comment, your profile picture may be visible to the public in the context of your comment.

4. Media

If you upload images to the Website, you should avoid uploading images with embedded location data (EXIF GPS). Visitors to the Website can download and extract any location data from images.

Google Analytics 4 (website statistics). On ba-visuals.com and shop.ba-visuals.com we use Google Analytics 4, a web analytics service provided by Google LLC (USA). It is loaded only after you consent to statistics cookies in our cookie banner. Google Analytics sets the cookies _ga and _ga_<ID> and collects pseudonymous information about your visit: the pages you view, approximate location (country and city level), device and browser data, how you reached us, and actions such as viewing a scene, adding it to the cart, starting checkout or sending the contact form. Google Analytics does not log or store your IP address. We use this information to understand how our website and shop are used and to improve them. We do not send your name, e-mail address or logo to Google Analytics. Google acts as our processor under the Google Data Processing Amendment. Google signals and the sharing of this data for improving Google’s products and services are switched off. The legal basis is your consent (Art. 6(1)(a) GDPR). Event data is deleted after 14 months. You can withdraw your consent at any time in the cookie settings (“Manage consent”).

Cloudflare Web Analytics. We use Cloudflare Web Analytics (Cloudflare, Inc., USA) to measure the performance and overall usage of our website. According to Cloudflare, this measurement does not store data in your browser (no cookies or local storage) and does not track you across visits. It sends technical performance data from your browser to Cloudflare. The legal basis is our legitimate interest in the security and performance of our website (Art. 6(1)(f) GDPR).

Search engine tools. We use Google Search Console and Bing Webmaster Tools to monitor how our website appears in search results. These services give us aggregated search statistics. They do not place cookies on your device through our website; we verify ownership of the website with a meta tag or a DNS record. Search Console data is also shown in our Google Analytics property (the two services are linked); this adds aggregated search queries and does not collect further data about you.

Meta Pixel (DJ VISUALS shop). On our shop at shop.ba-visuals.com we use the Meta Pixel provided by Meta Platforms Ireland Limited (Ireland). It is loaded only after you consent to marketing cookies in our cookie banner. The Meta Pixel then sets cookies (such as _fbp) and sends Meta information about your visit –⁠ your IP address, browser and device data, the pages you view and actions such as adding a scene to your cart, starting checkout or signing up for our e-mails (without your e-mail address). We use this information to measure the effectiveness of our ads on Facebook and Instagram, to show our ads to people who have visited the shop and to reach people with similar interests. For the collection and transmission of this data, we and Meta are joint controllers (Art. 26 GDPR); Meta processes the data further under its own Privacy Policy. The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time in the cookie settings (“Manage consent”).

Purchases on Gumroad. Purchases are completed on the Gumroad marketplace. When you open a product or complete a purchase, Gumroad’s pages may report your visit or purchase (for example the product, the order value and the currency, never your payment details) to our Meta Pixel. This takes place on Gumroad’s website, which is operated by Gumroad under its own Privacy Policy and cookie practices.

6. Embedded Content from Other Websites

Articles or pages on this Website may include embedded content (for example, videos, images, articles, etc.). Embedded content from other websites behaves in the same way as if you had visited the other website directly.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with the embedded content, including tracking your interaction if you have an account and are logged in to that website.

7. Who We Share Your Data With

We do not sell your personal data.

We may share your data with trusted service providers strictly on a need-to-know basis and under appropriate contractual safeguards, such as:

Hosting and infrastructure providers (EU-based hosting provider)

Meta Platforms Ireland Limited –⁠ measurement and targeting of our advertising on Facebook and Instagram (Meta Pixel on our shop, only with your consent)

If you request a password reset, your IP address may be included in the password reset email.

8. How Long We Retain Your Data

We retain personal data only for as long as necessary for the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements.

Comments and related metadata are retained indefinitely unless you request deletion.
User account data (if applicable) is retained for as long as the account remains active.
Server logs are retained for a limited period for security and maintenance purposes.
Google Analytics event data is deleted after 14 months. Analytics cookies expire after 2 years or when you withdraw consent or delete them.

Data collected through the Meta Pixel (only with your consent to marketing cookies) may be transferred to Meta Platforms, Inc. in the United States, which is certified under the EU–U.S. Data Privacy Framework.

Google LLC and Cloudflare, Inc. are certified under the EU–U.S. Data Privacy Framework. Where a certification does not apply or ceases to be valid, we rely on Standard Contractual Clauses.

11. Legal Basis for Processing (GDPR)

Where GDPR applies, we process your personal data under one or more of the following legal bases:

Categories of personal information we collect: identifiers (name, e-mail address), commercial information (orders and payments, processed by the Gumroad marketplace), internet activity (cookies, analytics, device and browser data) and any content you send us (for example your logo). We collect this information directly from you and through cookies, and we use it only for the purposes described in this policy.

We do not sell your personal information. If you consent to marketing cookies in our cookie banner, the Meta Pixel on our shop shares information about your visit with Meta for advertising purposes, which may qualify as “sharing” for cross-context behavioural advertising under California law. This happens only after you opt in, and you can stop it at any time by withdrawing your consent in the cookie settings (“Manage consent”). When you complete a purchase, the Gumroad marketplace may also report that purchase to our Meta Pixel (see Section 5). We do not collect sensitive personal information and we do not knowingly collect personal information from anyone under 16 years of age.

Your rights: the right to know what personal information we collect, use and disclose; the right to access it; the right to correct inaccurate information; the right to delete it; the right to opt out of sale or sharing (we do not sell; you can opt out of sharing by not giving, or by withdrawing, your consent to marketing cookies); the right to limit the use of sensitive personal information (not applicable, as we do not collect it); and the right not to be discriminated against for exercising any of these rights.

How to exercise your rights: e-mail us at [email protected]. We will verify your request using the e-mail address associated with your data and respond within 45 days. You may authorise an agent to submit a request on your behalf; we may ask for proof of that authorisation.
