These Terms govern purchases of custom DJ logo visuals in the BA - DJ VISUALS shop operated by BA visuals LLC.
BA visuals LLC, registered address 5 E 3rd St, Sheridan, WY 82801, USA, Company ID (TIN) 41-3356160 (“we”, “us”) operates the BA - DJ VISUALS shop at https://shop.ba-visuals.com (the “Shop”). Contact: [email protected]. These Terms & Conditions (“Terms”) apply to every order placed through the Shop. By placing an order you accept these Terms.
Payments are processed by Gumroad, Inc. as the merchant of record. Gumroad’s Terms of Service apply to the payment itself. The contract is concluded when Gumroad confirms your payment. We never see or store your card details. Prices are shown in EUR and do not include VAT or sales tax. Depending on your country, Gumroad may add VAT or sales tax at checkout; the final amount including tax is shown before you pay. Amounts shown in other currencies are rounded estimates and the charge is made in EUR.
Each product in the Shop is a custom-made DJ logo animation: we render the scene shown in the preview with your logo (or your DJ name if you do not have a logo). The delivered file is an MP4 video (H.264), 2560×1080px, silent, as described in the product and FAQ. The preview shows exactly the scene you receive; only the logo changes.
You enter your DJ name at checkout. After payment you upload your logo on your order status page (the link is in your confirmation e-mail), or you reply to that e-mail with the file attached. Some scenes use only your DJ name and need no logo. You confirm that you own the rights to the logo and any material you send us, or that you are authorised to use it. We may refuse orders containing unlawful, offensive or infringing content and will refund such orders in full. If you send us a low-quality logo, we will do our best, but the result depends on the quality of your file.
Orders are rendered manually and delivered by e-mail as a download link, usually within 24 to 48 hours after we have received your logo and DJ name. Delivery times are estimates, not a guarantee; if we cannot deliver within 7 days of payment, section 8 applies. After payment you receive a link to a live tracking page showing the status of your order. Download links stay valid for 30 days from delivery, so please save your files.
Small changes are possible after delivery – for example different colours or removing some of the elements. Just e-mail us at [email protected] after your order is delivered. Larger changes or new scenes are treated as a new order.
If you are a consumer in the EU/EEA or the UK, you normally have the right to withdraw from a distance contract within 14 days. Our visuals are made to your specification (your logo) and delivered as digital content. By placing an order you expressly request that we start work immediately and acknowledge that you lose your right of withdrawal once the rendering of your order has started and, in any case, once the files have been delivered. If you change your mind before we start rendering, e-mail us and we will refund you in full.
Because every order is custom-made and the preview shows the exact result, orders cannot be refunded once rendering has started or the files have been delivered. If you cancel before we start rendering, e-mail us as soon as possible and we will refund you in full. If we cannot deliver your order within 7 days of payment, we refund the full amount through Gumroad and inform you by e-mail. Rendering has started as soon as the status page of your order shows the step “RENDERING”. This does not affect your statutory rights as a consumer.
After payment you receive a non-exclusive, worldwide, perpetual licence to use the delivered files for your own performances, LED screens, live streams, promotion and social media, including commercial use. You may not resell, redistribute, sublicense or share the delivered files or the underlying scenes, and you may not use them to create products for third parties. The design and project files of each scene remain our intellectual property. We may show delivered work in our portfolio and social media; e-mail us if you prefer that we do not.
10.1 Discount codes and bundle discounts are applied at checkout on Gumroad. They have no cash value and apply only to the products and period stated with the discount.
10.2 Anyone with a valid e-mail address can join our affiliate program. A Gumroad account is not required. Joining is confirmed by a link that we send to the e-mail address. Every affiliate receives a personal link. Customers who order through it get 5 % off, or the bundle discount if that is higher.
10.3 The affiliate earns a commission of 25 % of the amount the customer actually paid, after discounts, in euro. The commission is paid only for the first order of a new customer, that is a customer who has not ordered from us before. Items from one cart ordered within 2 hours count as one order.
10.4 The commission becomes payable when we have delivered the order. We pay it out by bank transfer to the details the affiliate has entered on the private affiliate page, once the payable balance reaches our minimum payout amount. The affiliate is responsible for the correctness of these details. Every change of payout details must be confirmed by a link sent to the registered e-mail address.
10.5 No commission is paid on refunded or charged-back orders, on orders that are under dispute, or on self-referrals, that is orders placed by the affiliate or with the affiliate’s own e-mail address or payout account.
10.6 We may cancel commissions and remove an affiliate from the program in case of abuse, for example self-referrals, fake or manipulated orders, spam or misleading promotion. We may change or end the program at any time. Commissions that are already payable remain payable.
To the extent permitted by law, our liability for any order is limited to the amount you paid for it. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law. We are not liable for indirect losses, cancelled shows or technical incompatibility of a venue’s equipment. You are responsible for testing the files on your equipment before a show; if you need a different resolution or format, contact us before ordering.
We may update these Terms from time to time. The version published at the time of your order applies to that order.
We reply to e-mails within 24 hours on working days (Monday to Friday). If something is wrong with your order, e-mail us at [email protected] and we will try to resolve it quickly and fairly. Please e-mail us before opening a payment dispute so that we can solve the problem first. EU consumers can find information on out-of-court dispute resolution at consumer-redress.ec.europa.eu. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
