This Privacy Policy describes how BA visuals LLC (“we”, “us”, or “our”) collects, uses and protects the personal data you provide when you subscribe to our e-mails, use a discount code or join our affiliate program on https://shop.ba-visuals.com (the “Shop”). It supplements our general Privacy Policy, which continues to apply to the rest of the Website.
For the purposes of applicable data protection laws, including the EU General Data Protection Regulation (GDPR) where applicable, the data controller is:
Business name: BA visuals LLC
Registered address: 5 E 3rd St, Sheridan 82801, Wyoming, USA
Company ID (TIN): 41-3356160
E-mail: [email protected]
When you subscribe to our e-mails on the Shop, we collect and store:
When you join our affiliate program, we process the data described in Section 4 (“Affiliate program”). To prevent abuse of our forms we may process your IP address for rate limiting.
The Shop also stores your cart, your favourite scenes, your chosen currency and – if you open the Shop through a friend’s affiliate link – the friend discount in your browser’s local storage, so that the Shop works without an account. This data stays on your device; the contents of your cart and any friend discount are sent to our server only when you go to checkout, so that we can create your discount code.
If you have consented to marketing cookies, the Meta Pixel on the Shop also tells Meta that a sign-up has taken place (a “Lead” event) – your e-mail address is not sent to Meta. More about the Meta Pixel in Section 5 of our general Privacy Policy.
We process your data for the following purposes:
You can withdraw your consent at any time (see Section 8). Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.
Your bundle or friend discount code is created in the Gumroad marketplace, which handles all purchases and payments for DJ VISUALS products. When you complete a purchase, Gumroad processes your payment and personal data under its own Privacy Policy and Terms of Service. We never see or store your card details. Gumroad shares with us the information necessary to fulfil your order (e.g. your name, e-mail address, DJ name, selected scenes and uploaded logo).
Delivery of your files. We send the finished files as a download link to a folder on Google Drive (Google LLC, USA). The link works for 30 days after delivery and the files are then removed automatically.
Gumroad may also report a completed purchase (for example the product and the order value, never your payment details) to our Meta Pixel so that we can measure the results of our ads. This takes place on Gumroad’s website under Gumroad’s Privacy Policy.
Affiliate program. If you join our affiliate program, we process your e-mail address and, once you add them, your payout details (name and bank account) to run the program and to pay your commission. We keep them while you are an affiliate and afterwards for the period required by accounting and tax law. With each commission we store only a hashed form of a buyer’s e-mail address to apply the first-order rule. Payouts are made through our payment service provider, which receives your name and payout details.
If you subscribed to our e-mails, we may occasionally send you e-mails about new scenes, packs, discounts and news from BA visuals LLC. We send these e-mails ourselves from [email protected]; we do not sell or rent your e-mail address to third parties for their own marketing. You can unsubscribe at any time with the link in every e-mail, by replying to any of our e-mails or by writing to [email protected].
We share your data only with service providers that help us operate the Shop, under appropriate data processing agreements:
We may also disclose your data where required by law or to protect our legal rights.
Depending on your location, you may have the right to access, rectify or erase your personal data, to restrict or object to its processing, to data portability and to withdraw your consent at any time. To exercise any of these rights, or to unsubscribe from our e-mails, contact us at [email protected]. We will respond within the time limits required by applicable law.
BA visuals LLC is established in the United States and some of our service providers are located outside the European Economic Area. Where we transfer personal data of EU/EEA users to such countries, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission, or on your explicit consent.
Data collected through the Meta Pixel (only with your consent to marketing cookies) may be transferred to Meta Platforms, Inc. in the United States, which is certified under the EU–U.S. Data Privacy Framework.
We use appropriate technical and organisational measures to protect your data, including encrypted connections (HTTPS), access controls and rate limiting of our forms. No method of transmission or storage is completely secure, but we work to protect your data using industry-standard practices.
If you are a resident of California or another U.S. state with a comprehensive privacy law (for example Virginia, Colorado, Connecticut, Utah, Texas or Oregon), the following applies in addition to the rest of this policy.
Categories of personal information we collect: identifiers (name, e-mail address), commercial information (orders and payments, processed by the Gumroad marketplace), internet activity (cookies, analytics, device and browser data) and any content you send us (for example your logo). We collect this information directly from you and through cookies, and we use it only for the purposes described in this policy.
We do not sell your personal information. If you consent to marketing cookies in our cookie banner, the Meta Pixel on our shop shares information about your visit with Meta for advertising purposes, which may qualify as “sharing” for cross-context behavioural advertising under California law. This happens only after you opt in, and you can stop it at any time by withdrawing your consent in the cookie settings (“Manage consent”). When you complete a purchase, the Gumroad marketplace may also report that purchase to our Meta Pixel (see Section 4). We do not collect sensitive personal information and we do not knowingly collect personal information from anyone under 16 years of age.
Your rights: the right to know what personal information we collect, use and disclose; the right to access it; the right to correct inaccurate information; the right to delete it; the right to opt out of sale or sharing (we do not sell; you can opt out of sharing by not giving, or by withdrawing, your consent to marketing cookies); the right to limit the use of sensitive personal information (not applicable, as we do not collect it); and the right not to be discriminated against for exercising any of these rights.
How to exercise your rights: e-mail us at [email protected]. We will verify your request using the e-mail address associated with your data and respond within 45 days. You may authorise an agent to submit a request on your behalf; we may ask for proof of that authorisation.
If you believe that we have processed your personal data unlawfully, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU/EEA member state of your habitual residence, place of work or place of the alleged infringement.
We may update this Privacy Policy from time to time. The current version is always published on this page together with the date of the last update.
We use cookies and similar technologies to run the website, to measure how it is used and, if you agree, to measure our advertising. You can change your choice at any time.
